Garuda Counsel is a legal services practice based at 156 Sathorn Road, Si Lom, Bang Rak, Bangkok 10500, Thailand. We provide counsel in matters relating to pension entitlements, pension calculation disputes, and cross-border pension rights. References to "we," "us," or "the firm" in these terms refer to Garuda Counsel.

2. Scope of These Terms

These terms apply to:

• Individuals who submit an enquiry through this website
• Clients who engage Garuda Counsel under a separate written service agreement

Where a formal engagement letter or service agreement has been signed, its terms take precedence over these general terms in the event of any conflict.

Nothing on this website constitutes legal advice, nor does it create a solicitor-client or practitioner-client relationship. A professional relationship with Garuda Counsel arises only upon the execution of a written engagement letter and the payment of any applicable fee.

• Cross-Border Pension Rights Counsel — ฿7,800

Fees listed on this website reflect our standard service rates at the time of publication. Where the scope of a matter differs materially from the standard service description, fees will be discussed and confirmed in writing before work begins. All fees are quoted in Thai Baht and include applicable professional charges unless otherwise stated. Government filing fees, third-party charges, and disbursements are not included and will be itemised separately if they arise.

5. Client Responsibilities

Clients are responsible for:

• Providing complete, accurate, and timely information and documentation as requested
• Informing us promptly of any changes in their circumstances that may be relevant to the matter
• Responding to correspondence within a reasonable period
• Meeting agreed payment obligations in accordance with the engagement letter

We rely on the accuracy of information provided by clients. Garuda Counsel accepts no liability for outcomes arising from incomplete or inaccurate information supplied to us.

6. Confidentiality

We treat all client information with strict confidentiality in accordance with applicable professional obligations and our Privacy Policy. Information disclosed to us will not be shared with third parties except where required by law, necessary to advance the client's matter with the consent of the client, or where we are under a legal or regulatory obligation to disclose.

7. Limitation of Liability

To the extent permitted by applicable Thai law, the aggregate liability of Garuda Counsel in connection with any engagement shall not exceed the total fees paid by the client in respect of that matter. We are not liable for indirect, consequential, or incidental loss arising from the engagement of our services or the use of this website, including loss of income or deterioration of a pension claim due to factors outside our control.

Nothing in these terms excludes liability for fraud, wilful misconduct, or any other liability that cannot lawfully be excluded.

8. Intellectual Property

All content on this website — including text, layout, graphics, and service descriptions — is the property of Garuda Counsel. You may view and print materials for your personal use. Either party may bring an engagement to a close by providing written notice. Where we withdraw from a matter, we will give reasonable notice and take steps to minimise any adverse effect on the client's position. Fees for work completed up to the date of termination will remain payable. Any documents belonging to the client will be returned or transferred on request following settlement of outstanding fees.

12. Complaints

We are committed to the quality of our work. If you have a concern regarding the service you have received, we ask that you raise it with us in writing in the first instance. We will acknowledge your concern within five working days and provide a substantive response within thirty working days. Our complaints procedure is available on request.

13. Governing Law and Jurisdiction

These Terms & Conditions and any engagement with Garuda Counsel are governed by the laws of the Kingdom of Thailand. Any dispute arising in connection with these terms or our services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand, unless the parties agree otherwise in writing.

14. Changes to These Terms

We may revise these Terms & Conditions from time to time. The date at the top of this page reflects when they were last updated. Continued use of this website or our services following any revision constitutes acceptance of the updated terms. For matters already under engagement, any material change to the terms of service will be communicated by email and will not take effect without your acknowledgement.
